In the event of any conflict between these Terms and our Privacy Policy regarding data privacy, the Privacy Policy will prevail to the extent of that conflict.

Our Platform assists healthcare providers with AI-driven recording, transcription, and data management for pre-employment medical consultations and occupational health assessments.

While the Platform may generate automated suggestions or flags, these do not constitute medical advice.

All intellectual property rights in the Platform (including software code, AI models, brand names, and associated documentation) remain the exclusive property of Tell Claire or our licensors.

We grant you a non-exclusive, non-transferable licence to use the Platform for your internal medical and business purposes as described in these Terms, subject to compliance with all applicable laws and regulations.
5.3 Feedback
If you provide feedback or suggestions for improving our Platform, we may use such feedback without obligation or compensation to you.
6.1 AI Limitations
Our Platform uses AI-based transcription and analysis, which may generate inaccuracies or require human verification. We do not guarantee that outputs will be error-free or fit for any specific purpose.
6.2 No Warranty
Except as expressly stated in these Terms or required by non-excludable Australian consumer laws, the Platform is provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude all warranties, whether express, implied, or statutory.
6.3 Compliance with Healthcare Obligations
You acknowledge that it is your sole responsibility to ensure your use of the Platform meets clinical, legal, and regulatory requirements, including but not limited to the Privacy Act 1988 (Cth) and other healthcare legislation in your state or territory.

To the maximum extent permitted by Australian law, we are not liable for any direct, indirect, incidental, or consequential damages arising out of or related to your use or inability to use the Platform.

If any dispute arises relating to these Terms, both parties agree to make good faith efforts to resolve the matter. If unresolved, the parties shall engage in mediation before proceeding to litigation or arbitration.

We will provide notice of material changes (e.g., via email or a prominent notice within the Platform). Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remainder will remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

We are not liable for any delays or failures in performance resulting from events beyond our reasonable control, such as natural disasters, wars, pandemics, or internet service disruptions.

These Terms, along with any applicable separate contract (e.g., Master Services Agreement) and our Privacy Policy, constitute the entire agreement between you and Tell Claire regarding the use of the Platform.
